Standard Custody Agreements

The good news: “Studies show that shared custody situations are the best practices when both parents are cooperative and respectful, agree on shared custody, and work out their emotions,” says JoAnne Pedro-Carroll, Ph.D., clinical psychologist and author of Putting Children First: Proven Parenting Strategies to Help Children Thrive Divorce Thrive Thrive Divorce. “These qualities make it more likely that parents will help their children adapt to family changes.” While agreements may vary from case to case, a standard custody agreement should cover some key issues: it`s good to know that physical and legal custody must be at the heart of any agreement reached. My sister and her five-year-old husband decided that for the happiness of their family, it would be better to divorce. As they have two children together, this information should be useful when she soon meets with child custody lawyers to discuss the details. These situations have forced families to make difficult custody decisions under extremely uncertain circumstances. Divorce was about you, but custody is that of the children. If you have divorced and your minor children live with you, you have custody of them. Most courts tend to grant a parent sole physical custody, while the non-custodial parent has access. Even if it is established that the child must spend time with both parents to thrive, the courts are increasingly reluctant to give shared custody of the children. The most common agreement is one in which one parent has sole physical custody, both parents have legal custody, and visitation time is granted to the non-custodial parent.
